Terms of Service

By accessing or using Lookups.io ("Service"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you disagree with any part of these Terms, you must immediately discontinue use of the Service.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. Lookups.io will not be liable for any loss or damage arising from your failure to protect your account information.

You may not share, transfer, or sell access to your account. Each account is for a single user only unless explicitly authorized under an enterprise agreement.

By using the Service, you acknowledge and agree that Lookups.io may collect, process, and store data related to your use, including but not limited to:

• Search queries you submit through the Service
• Search results returned by the Service
• Usage patterns, access logs, and interaction data
• IP addresses, device information, and session metadata

This data may be retained for purposes including service improvement, abuse prevention, analytics, legal compliance, and internal record-keeping. Lookups.io reserves the right to retain search queries and results indefinitely, even after account termination, in anonymized or aggregated form.

You grant Lookups.io a non-exclusive, royalty-free, worldwide license to use, process, and store data generated through your use of the Service for the purposes described above.

Lookups.io implements technical measures to protect user data, including:

• Database infrastructure protected behind a VPN — direct access to stored user data is restricted to VPN-authorized connections only
• Hashed and salted password storage using bcrypt (passwords are never stored in plaintext)
• Secure, HTTP-only authentication cookies with SameSite and Secure flags
• Rate limiting on search and API endpoints to prevent abuse
• IP-based access controls and blocking
• CORS policies restricting cross-origin requests
• CAPTCHA verification to prevent automated abuse

No system is completely immune to risk. By using the Service, you acknowledge that you understand and accept the inherent risks of transmitting data over the Internet. See our Privacy Policy for additional details.

You agree not to use Lookups.io for any unlawful or prohibited purpose. Without limitation, you agree not to:

• Stalk, harass, threaten, or intimidate any individual
• Engage in discrimination or any activity that violates civil rights laws
• Commit or facilitate identity theft, fraud, or impersonation
• Send spam, unsolicited communications, or engage in unauthorized marketing
• Violate the privacy rights of any individual
• Use the Service in connection with any FCRA-regulated purpose (see Section 3)
• Resell, redistribute, sublicense, or commercially exploit data obtained from the Service without prior written consent
• Scrape, crawl, or use automated means to access the Service beyond normal API usage
• Attempt to reverse-engineer, decompile, or circumvent any security measures of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use the data to build a competing product or service
• Any purpose prohibited by applicable local, state, national, or international law

Lookups.io reserves the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this provision, including removing content, suspending or terminating accounts, and reporting violations to law enforcement.

Billing: Subscriptions are billed in advance on a recurring basis (monthly or annual) through our third-party payment processor, Stripe. By providing payment information, you authorize us to charge the applicable fees to your designated payment method.

Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You are responsible for canceling your subscription before the next billing cycle to avoid charges.

Refund Policy: All sales are final. We generally do not offer refunds for any subscription fees or charges already billed. In exceptional circumstances, refund requests may be considered at our sole discretion. Contact [email protected] for any billing disputes within 7 days of the charge.

Price Changes: We reserve the right to modify pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle following at least 30 days' notice.

Free Trials: If a free trial is offered, you may be required to provide payment information. If you do not cancel before the trial period ends, you will be automatically charged for the applicable subscription plan.

Chargebacks: If you initiate a chargeback or payment dispute without first contacting us, we reserve the right to immediately suspend or terminate your account. Filing a fraudulent chargeback is a violation of these Terms.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. LOOKUPS.IO SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, Lookups.io makes no warranty or representation that:

• The information returned by the Service is accurate, complete, current, or reliable
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

Lookups.io provides data from a combination of proprietary datasets and third-party sources, including publicly available records and external databases. While we make reasonable efforts to maintain the quality of our proprietary data, we do not independently verify all information and are not responsible for inaccuracies in third-party source data.

Data Availability: Lookups.io is a data aggregator that sources information from multiple third-party providers. Results that you have previously accessed or unlocked are not guaranteed to remain available indefinitely. Third-party data sources may modify, update, or remove information at any time, and Lookups.io has no control over such changes. If a third-party source alters or removes data, previously available results may become unavailable, incomplete, or different from what was originally returned. Lookups.io is not responsible for the loss, removal, or modification of any data by third-party sources and makes no guarantee of continued access to any specific search results.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOOKUPS.IO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of, or inability to access or use, the Service
• Any conduct or content of any third party on the Service
• Any information obtained from the Service
• Unauthorized access, use, or alteration of your data or account
• Any decisions made or actions taken based on data provided by the Service

IN NO EVENT SHALL LOOKUPS.IO'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO LOOKUPS.IO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

You agree to indemnify, defend, and hold harmless Lookups.io, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including any privacy or intellectual property right
• Your violation of any applicable law, rule, or regulation, including the FCRA
• Any claim or damages arising from your use of data obtained through the Service
• Any misrepresentation made by you

This indemnification obligation will survive the termination of your account and these Terms.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of the FCRA Disclaimer (Section 3)
• Violation of the Acceptable Use Policy (Section 7)
• Fraudulent or illegal activity
• Non-payment or chargeback disputes
• At our sole discretion, for any reason or no reason

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability. No refunds will be issued for any remaining subscription period upon termination.

The Service, including its original content (excluding user-provided data), features, and functionality, is and will remain the exclusive property of Lookups.io and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms.

Informal Resolution: Before filing any formal dispute, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If the dispute is not resolved informally, you and Lookups.io agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.

Class Action Waiver: YOU AND LOOKUPS.IO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. To the extent that any lawsuit or court proceeding is permitted hereunder, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Delaware.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lookups.io regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
